Notice: Penalty for Not Meeting Diversion Rates

Effective Jan. 1, 2022 per Ordinance 3183-21 (Amendment) and Municipal Code 16.74.070

If your project fails to meet the 65% diversion rate requirement, you must pay a penalty. The penalty applies to projects with permits issued this year. It also applies to projects started in prior years and submitted for final inspection in 2022.

Penalty formula: Square footage x (65% - [actual diversion rate]) = $Total penalty
Example: 2,045 sq ft x (.65 - .61) = $818

Requirements for demolishing, remodeling, constructing, or cleaning up a site:

Recycling or Reusing (diverting) Requirements

Are you doing a remodel or demolition project and plan to remove 50% or more of the exterior wall?

If yes, you must recycle or reuse (divert) at least 65% of the project's nonhazardous waste. Before you apply for a building or demolition permit, you will need to follow the City's waste tracking requirements.

Moving Materials

The City's hauler, Specialty Solid Waste & Recycling is the only disposal company allowed to move materials off-site. They are the City's authorized franchised hauler. All containers used to collect material must* be from Specialty Solid Waste & Recycling. If you violate this requirement, we will cite, fine and impound your container.

*Certain activities are exempt from this requirement. See Municipal Code 8.16.160 Exclusions.
