Each year in the United States, 561 billion disposable foodware items turn into 4.9 million tons of waste. Unused food items include utensils, straws, coffee stirrers and condiment packages. These items are often not recyclable. They get dumped in the landfill, or litter the streets, and end up polluting our waterways and ocean.

To reduce unnecessary waste and litter from disposable foodware, California established a state law, AB 1276. These restrictions went into effect in 2022. They apply to restaurants, food vendors and take-out delivery services.

How to Meet Regulations

Only give out foodware items when customers request them. This applies to dining in, take-out and food delivery.

Train your staff on the regulations. They can't hand out items that aren't asked for by customers.

Do not provide bundled foodware items. Everything must be available as separate items.

For online orders:
List each foodware item and condiment along with a box each customer must check to receive the item.
